<description>[CDATA[ Debt collectors often attempt to collect old and delinquent debt from consumers past the Statute of Limitations (SOL). These defaulted debts are sold to secondary creditors to create what has become a multimillion dollar industry. Because these debts are based on contracts between the consumer and the original creditor, debt collectors may only succeed in lawsuits if the suits are brought within each state’s Statute of Limitations. Please see your state’s SOL below. It is extremely important that you do not pay toward a debt that is past the SOL. If you pay any amount toward a debt, even if it is past the Statute of Limitations, you may reaffirm the debt and the SOL may start over. When presented to courts as a defense, the Statute of Limitations prevents creditors from obtaining judgments for old debts. After Seven years, one hundred and eighty days, old debts should not appear on a consumer’s credit report because they are considered to be obsolete. Secondary debt collectors are governed by the Fair debt Collection Practices Act (FDCPA). A debt collector who is governed by the FDCPA may violate the act if a debt collector sues or threatens to sue on a debt which is not collectable because of the Statute of Limitations. Once a consumer retains a lawyer for representation against a debt lawsuit and a debt collector who is governed by the FDCPA knows it, that debt collector may contact only the lawyer and not the consumer. The client-lawyer relationship ends the unwanted intrusions on a consumer’s life by the debt collector. The information discussed above is not well known or understood by consumers. Typically, consumers do not talk to other people about their financial problems. <description>[CDATA[ Have credit card companies, debt collection agencies, debt collectors, or collection attorneys served you with a Summons and Complaint or an Arbitration Notice for a credit card, medical, cell phone, or other consumer debt? If they have, please do not panic. You do have options. There may actually be defenses to these types of lawsuits and thus you may not have to pay your debt or at least the full amount.  Creditors have the burden of proof. That means that their records must justify the award or debt they are attempting to collect. Proper records that creditors should keep on file and have in order to bring suit against consumers include signed credit card disclosure statements, monthly billing statements, and documents bearing the debtors signature. If their records fail to include these items and they cannot prove their allegations, you may successfully defend against their lawsuits. In most cases, creditor lawsuits are seldom challenged and consumers are saddled with default judgments, which can last for many years depending upon the state in which there brought. Default Judgments mean that you have to pay the full amount of the award the creditor seeks, in addition to possible attorney’s fees and court costs. If you have a judgment that has been brought against you, your credit rating may be affected greatly. A poor credit rating will cause you to pay higher interest rates on your loans and higher insurance premiums on your homes and vehicles. In addition to higher interest rates, consumers with lower credit scores may have difficulty being hired or switching jobs because employers often read credit reports before hiring new employees. Therefore, it is imperative that you act quickly and respond to avoid default judgments before it is too late.  In some instances, an attorney may be able to represent you regarding a credit card debt that has gone or will soon go to a collection agency.  Said attorney may be able to negotiate your debt or lower it for you to an amount you may be able to afford.  Some consumers have incomes and assets that are exempt from creditors such as Social Security, pensions, homesteads, and motor vehicles up to certain limits.  In addition many debt collectors are governed by the Fair Debt Collection Practices Act (FDCPA).  The attorneys located on the FDCPA Directory page may be able to help you.

<description>[CDATA[ The Fair Debt Collection Practices Act (FDCPA) is a Federal act designed to help protect consumers who are being harassed, abused, threatened, or intimidated by collection agencies, debt collectors, and collection attorneys. The FDCPA applies to collection agencies, creditors using false names, creditors collecting for other creditors, collection attorneys, purchasers of old and delinquent debt, repossession companies, and suppliers or designers of deceptive collection letters (forms). The Fair Debt Collection Practices Act typically excludes creditors collecting their own debts, which includes banks and credit card companies like Visa, MasterCard, American Express, MBNA, Chase, Citibank, etc. Currently there are 49 states that are governed by the FDCPA.  The Fair debt Collection Practices Act allows consumers a chance to help regulate the debt collection industry, which has been historically abusive. Despite its abusive nature, a few debt collectors do not violate state and federal laws, but because of the sheer volume of high consumer debt, many debt collectors go unpunished and even unnoticed for violating the FDCPA. Their violations often lead to consumers paying debt that they may not have had to pay.  The Fair Debt Collection Practices Act enables consumers to receive $1,000.00 in statutory damages, together with actual damages, plus attorneys fees and costs.
